GENERAL TERMS AND CONDITIONS OF SALE
Preamble
- The Site refers to the Internet site [www.sans-arcidet.fr] published by the company Sans Arcidet.
- The term User refers to all Internet users, whether registered or not, who browse the site.
- The term Customer refers to all Internet users connected to the site [www.sans-arcidet.fr].

Article 4: Validation of your order
The Sans-Arcidet website allows the customer to check the content of their order, modify it if necessary and then confirm it definitively. The order will only be definitively recorded after the last validation of the order summary screen. This last “click” is assimilated to the handwritten signature referred to in article 1341 of the French Civil Code, hereinafter referred to as the “acceptance click”. As from the “acceptance click” indicated above, the order is considered to be irrevocable and may only be challenged in the cases set out below. The information relating to your order is subject to automated data processing within a secure online payment system. The purpose of this automated data processing is to define a transaction analysis level and to combat credit card fraud. Sans-Arcidet Collection is the recipient of the data relating to your order. The non-transmission of data relating to your order prevents the completion and analysis of your transaction. In accordance with the French Data Protection Act of 6 January 1978, you have the right to access, rectify and object to all of your personal data at any time by writing, by post and providing proof of your identity, to : Société Sans-Arcidet, 10 rue Charlot – 75003 Paris, France.
Article 5: Order confirmation and tracking
Once the order has been definitively registered, a confirmation e-mail is sent to the customer. By keeping this e-mail and/or printing it out, the customer has proof of his/her order, which the Company recommends that he/she keeps. Please note: this e-mail confirms that the customer’s order has been taken into account by the Company and not that the Product ordered is available. If the Product is out of stock, the Company will contact the customer within 10 working days of sending the confirmation e-mail to offer the customer, which the customer already accepts, either a new delivery date for the Product, or a replacement Product, or the cancellation and reimbursement of the order.
Article 6: Prices, payment and billing
The prices of the Products are indicated in euros, inclusive of tax and exclusive of delivery charges. Delivery costs, as indicated in article 7.1 of these general terms and conditions, are at the Customer’s expense. Any change in the VAT rate will automatically be reflected in the price of the Products. Payments will only be made by credit card (Visa, Mastercard or Paypal) at the time of ordering. An invoice will be sent with the Product.
Article 7: Shipping fees and delivery
The Products ordered will be delivered to the address indicated by the Customer. The Customer is responsible for the address indicated at the time of ordering and for the correct receipt of the Product. Shipping fees are at the customer’s expense. Delivery times: except in cases of force majeure or in the event of the Customer specifying otherwise before placing the order, delivery times will be between 48 and 96 hours, subject to stock availability. Delivery times begin the day after the date on which the order is registered.
Article 8: Geographical area of delivery
The Products offered for sale by the Company are offered and delivered to customers domiciled in mainland France, Europe and the rest of the world.
Article 9: Complaints about non-conforming products
The customer must check the condition of the packaging and the conformity of the Product delivered. Any complaint concerning apparent defects or the non-conformity of the Product delivered must be notified by the customer within three working days of the date of receipt of the Product by the customer, by sending:

If no complaint is made within the aforementioned period, the Products delivered will be deemed to be in conformity and accepted by the customer.
Article 10: Withdrawal period
The withdrawal period granted to the customer for the purchase of goods, under the law, is 15 (fifteen) clear days from the date of receipt of the order. During this period, the customer may return, at his/her own expense and without incurring any other penalties, any Product(s) that do not suit him/her. It is understood that the Product(s) returned at the customer’s expense must be in new condition and in its (their) original packaging, as delivered by the Company. No Product may be reimbursed until it has been returned by the customer and received by the Company, in new condition and in its original packaging, as delivered by the Company.
Products in the Outlet section cannot be returned or exchanged.
Article 11: Warranty and after-sales services
In any event, the customer benefits from the warranty against hidden defects: thus, in the event of a manufacturing defect in the Product making it unfit for use, the customer may contact the Company’s after-sales service:

– or by sending a registered letter with acknowledgement of receipt to: Société Sans-Arcidet, 10 rue Charlot, 75003, Paris, France. All Products marketed by the Company benefit from a conventional warranty against hidden defects provided by the Company’s suppliers. To benefit from this warranty, the customer must send the Product to the Company, at his own expense, enclosing the purchase invoice. The Company then undertakes to send the customer, at their own expense, a Product free of hidden defects, by exchange (except in the event of stock shortage). If the Product is out of stock and the supplier is unable to exchange it, the customer will be offered either a similar Product or a refund of the original Product.
Article 12: Payment methods
Depending on the country we serve, we can offer you the possibility of paying for your purchases using different methods of payment:
• credit card (CB, Visa, Master Card)
• PayPal
Confirmation of your payment is a prerequisite for starting the delivery process. This confirmation comes from your bank in the case of payment by credit card, or from PayPal in the case of payment via PayPal.
Article 13: Secure transactions
In your interest and that of Sans-Arcidet, payment security is one of our priorities. This is why payment by credit card is made via the PCI DSS-certified Paybox secure solution. We also have a mail order contract with Banque Populaire.
Also worth noting, again with a view to payment security: above a certain order value, the 3D Secure system may be activated, requiring you to enter a secret code sent to your mobile phone.
Finally, as part of our security measures, we may carry out certain checks, which may lead us to ask for any proof we consider useful and to extend the time taken to dispatch the order.
Article 14: Retention of title
The Company expressly reserves ownership of the Products delivered until full payment of their price in principal and interest. The above provisions do not prevent the transfer to the customer of the risks of loss or deterioration. In the event of failure to pay in full, the Company shall be entitled to demand the return of the Products delivered, the costs of which shall be borne by the customer.
Article 15: Personal information and promotional offers
In application of French law no. 78-17 of 6 January 1978 relating to information technology, files and civil liberties, the information requested from the customer is required to process the order and is intended for the Company’s departments. Customers have the right to access information concerning them. On request, this information may be communicated to them and, in the event of error or modification, rectified. The customer may also object to this information being communicated to third parties by sending a letter to: Société Sans-Arcidet, 10 rue Charlot – 75003 Paris, France. The Customer expressly accepts that the Company may freely transfer said data to companies belonging to the same group as the Company. In accordance with the French law of 21 June 2004 on confidence in the digital economy, the Customer agrees to receive promotional offers by e-mail, by ticking the box provided for this purpose on the Company’s website when registering on a site managed by the Company. They may opt out of receiving promotional offers at any time by clicking on the link provided for this purpose in each promotional offer e-mail sent or by visiting their personal space.
Article 16: Liability of the Company
The Company shall not be liable for any failure to fulfil its contractual obligations in the event of force majeure or unforeseen circumstances, including, but not limited to, disasters, fire, war, internal or external strikes, internal or external failures or breakdowns, and in general any event that prevents the proper execution of orders. The Company also accepts no liability in the event that the non-performance or poor performance of the contract is attributable to the customer. In any event, if the non-performance or poor performance of the contract is clearly attributable to the Company, the Company will only be liable to pay compensation up to the amount of the sums paid by the customer in respect of the price of the product and delivery costs.
Article 17: Entire agreement
These general terms and conditions and the related sections (security, payment, delivery, warranty, after-sales service) represent the entirety of the rights and obligations of the parties concerning orders for Products on the Internet. No general or specific conditions communicated by the customer may be incorporated into these General Terms and Conditions of Sale.
